1.- COMPANY ORGANISING THE PROMOTION

The company “Manufacturas Gre, S.A.U. ” (from now on, “Manufacturas Gre“) with registered office at Ctra. De Mungia a Gernika, km. 0,50, 48100 Mungia, Bizkaia, Spain and with tax identification number (N.I.F.) A48067383 organises for promotional purposes the prize draw (hereinafter, the “Promotion“) of national scope, to be carried out via the Internet, exclusively for users resident in Spain and France and of legal age in accordance with the provisions of the section on conditions for participating.

 

2.-START DATE AND END DATE

The Promotion will start on 22 June 2022 at 17:00 of the first publication of the relevant draw and will end on 22 August 2022 at 23:59.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The requirements for participation are as follows:

• Participation is open to natural persons of legal age residing in Spain and France.
• Only those participants who follow the instructions in the publication of each competition and therefore comply with the participation requirements and mechanics of the promotion will be able to participate.
• The personal data with which participants fill in the registration form must be truthful.
• Participants may only register (1) once for this promotion.

 

Hereinafter referred to as the “Participants” or the “Participant“.

Legal entities and minors are not eligible to participate. Employees of Manufacturas Gre S.A.U. and their family members are not eligible to participate.

The mechanics of the Promotion consists of commenting on the publication of the prize draw that will be published via email (newsletter). The conditions will be as follows: a Blue Connect must be purchased after the start date of the draw and a photo must be attached. The winner must also present the purchase receipt dated after the start of the draw.

 

4.- CONDITIONS OF THE PROMOTION AND PRIZES

One winner will be drawn by lot at the end of the relevant draw period.

The selection of the winners will be made randomly through the Excel random system, which guarantees the transparency of the result of the draw and as proof of this, issues a certificate of validity for each of its draws, the result of which is unalterable by the organiser of the draw, and which any participating user can request from the organiser.

If the winner has not made contact or has not responded, after twenty (20) days a new draw will be held with a new winner.

The prize of the Promotion will consist of a Zodiac robot cleaner with reference GT2120 for the amount of 650€.

 

5.- LIMITATIONS

If it becomes evident that any of the Participants do not comply with the requirements set out in these Legal Bases, or the data provided to participate are not valid, their participation will be considered null and void for all purposes and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded by virtue of this Promotion. In this regard, Manufacturas Gre reserves the right to verify the validity of the participations (including, among others, the Participant’s identity, age, postal address provided) and to exclude any Participant who does not comply with the Legal Bases or who alters the process of participation in the Promotion.

The prize awarded will not be transferable or subject to change, alteration or compensation at the Participants’ request and cannot be exchanged for any other product or money.

Manufacturas Gre reserves the right to make any changes, suspend or extend this Promotion, if there is just cause and prior legal notice is given.

The winner will be responsible for any fiscal or tax charges that the acceptance of the prize may entail, as well as any other expenses derived from the promotion that are not expressly assumed by Manufacturas Gre in these Legal Bases.

A period of fifteen (15) calendar days from the date of the awarding of the prize is established to make any justified claim. Manufacturas Gre reserves the right, if necessary, to substitute the prize for another of similar characteristics.

 

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, to personal and family privacy and to one’s own image will not be allowed either. Manufacturas Gre shall not be held responsible for any damage caused by the comments made by participants in the Promotion, which at any time may offend the sensibilities of other participants.

 

7.- EXEMPTION FROM LIABILITY

By way of example, but not limitation, Manufacturas Gre is exempt from possible losses, theft, delays or any other circumstances attributable to third parties that may affect the development of this Promotion, as well as from any responsibility for the use made by the Participant with respect to the prize obtained from this Promotion, and does not assume any responsibility for any damage or harm of any kind that the Participants, winner or third parties may suffer.

Manufacturas Gre assumes no responsibility in cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of Manufacturas Gre and that affects the normal development of the Promotion, we reserve the right to cancel, modify or suspend the same, including the participation website.

 

8.- FACEBOOK

The promotion is in no way sponsored, endorsed, administered by, or associated with Facebook and Participants release Facebook from any and all liability for any damages arising from the promotion.

9.- PROTECTION OF PERSONAL DATA

For the purposes of the provisions of current legislation on the protection of personal data, we inform you that the personal data will be processed by Manufacturas Gre as the data controller in order to (i) manage your participation in the Sweepstakes, as well as (ii) verify that you meet the requirements for participation in the Sweepstakes. Furthermore, you are informed that in the event of being selected as the winner, we may request additional information via private message in order to carry out or agree on the delivery of the Prize, in accordance with the provisions of these Rules.

The basis of legitimacy is the provision of your consent.

If you do not agree with the above, please do not participate.

Your data will not be transferred, sold, leased or otherwise made available to third parties, except to service providers who perform certain activities for Manufacturas Gre, but in no case will they process the data for their own purposes. Some of these providers may be outside the European Union, although, in any case, we will ensure that such data processing is always protected with the appropriate guarantees established by current data protection regulations.

Personal data provided in connection with participation in the Sweepstakes will be retained for the duration of the Sweepstakes and for two (2) months after the end of the Sweepstakes for the purpose of following up any disputes.

We remind you that you may at any time exercise your rights of access, suppression, opposition, rectification, limitation or portability of your data by contacting the Marketing Department, or by sending an e-mail to: dataprivacy@fluidra.com, however, we remind you that the exercise of any of these rights as well as the refusal to process your personal data for the purposes mentioned above may imply that you may not participate in the Sweepstakes, and we will inform you of this in due course.

If you have any questions about the processing of your personal data, or about any other related matter, you can contact our Data Protection Officer through the channel mentioned above, with the reference “DPO”. If you do not receive a reply within a reasonable period of time, you may file a complaint with the relevant Data Protection Authority: www.aepd.es.

 

10.- CHANGES

Manufacturas Gre reserves the right to modify or extend these Terms and Conditions, insofar as it does not prejudice or undermine the rights of the Participants in the Promotion, in which case it will be informed.

 

11.- APPLICABLE LAW AND JURISDICTION

These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the participant’s domicile will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these Legal Bases.
